FOX47 NEWS - Man Sentenced to Prison for 2007 Rape
Twelve years in prison and five years extended supervision -- that is the sentence handed down to convicted rapist Anderson Dasilva.
Judge Patrick Fiedler called it a significant sentence, but a necessary one.
Dasilva did not admit any guilt or show any remorse during the sentencing -- something Judge Fiedler called an indicator Dasilva could assault someone again.
Dasilva, 29, listened as prosecutors recounted the night in March 2007, when they say he met a woman at a bar downtown, drove her to a secluded area, and raped her.
"Not only being forced sexually, but being threatened with death, saying he was gonna kill her if she didn't do it. And she was picturing herself being killed, and thrown along the roadway," said Michael Finley, assistant district attorney.
It took police more than a year and a half to issue an arrest warrant, something Dane County district attorney Brian Blanchard says was a big mistake.
A jury eventually convicted Dasilva of sexual assault in May 2009. During sentencing, Dasilva, a Brazilian man, spoke through his Portuguese interpreter, asking for leniency.
"I don't know if I'm a bad person," he said. "I just want the chance to be the good person I think I am."
Dasilva's wife, Jessire, who live in Massachusetts, spoke via telephone, portraying her husband as a family man, who deserved to see his 2-year-old son.
"He supported me," she said. "He gave me everything I needed. We went out together. He did everything he could to make us a happy family."
Judge Fiedler said Dasilva made his family victims too, when he preyed on a vulnerable woman.
"She pleaded for her life, simply to be left alone, and for help," Fiedler said. "And unfortunately help was not forthcoming, because your motives here were entirely selfish."
Dasilva is not eligible for earned release. The judge also ordered him to pay $3,772.93 in court costs to Dane County.
He could have to pay more money in restitution to the victim, who is still under going counseling. He also has a federal immigration hold to deal with.
Dasilva will be registered as a sex offender for the rest of his life.
