BARABOO, Wis. - A 3-month-old boy, Jose, was taken from his home in the town of Honey Creek by his noncustodial father Thursday morning, Sauk County Sheriff Chip Meister said.
The mother said she and Luis Angel Gutierriez got into a fight at a club in Wisconsin Dells Wednesday night, according to a criminal complaint. When she got home Gutierriez and her son were not home.
She assumed they would return, but when they didn't she called police around 7:10 a.m., according to the complaint.
Gutierriez told his brother, who was babysitting Jose, that he was going to New York to stay with a cousin when he left, according to the criminal complaint. Gutierriez later told his brother he switched trucks with his friend in Juneau County.
The District Attorney’s Office issued a temporary felony warrant for Gutierriez's arrest, Meister said. He was pulled over around 1 p.m. in Michigan, and will likely be charged with interfering with child custody.
Authorities said they are working on reuniting the mother and baby in Michigan.
Meister said there were no prior domestic situations between the parents, who live together with the baby, before this situation.
The abduction did not qualify for an Amber Alert because the mother did not think the child was in any danger, officials said.
