MADISON, Wis. - The state Supreme Court says it deadlocked on whether to allow the alleged victim to testify in a sexual assault case against a Racine County billionaire.
Prosecutors charged Samuel Curtis Johnson, son of the late SC Johnson chairman Sam Johnson, in 2011 with sexually assaulting a teenager. Johnson's attorneys want the girl's therapy records but she has refused to turn them over.
A state appeals court ruled in 2012 she can't testify until she produces the records.
A divided Supreme Court ruled in July under varying rationales she doesn't have to turn over records and could testify. But the court said Wednesday that decision was a deadlock. That means the appellate decision stands and she can't testify.
A message left at the Racine County district attorney's office wasn't immediately returned.
