MADISON, WIS. -- A Janesville doctor was sentenced Tuesday for prescription drug fraud, according to a state Department of Justice release.
Richard Barney, 53, was sentenced to two years of probation and a $3,000 fine, officials said. Barney pleaded guilty to the charge on Dec. 17. In addition to the probation and fine, Barney agreed to surrender his registrations that allow him to prescribe controlled substances and not to reapply for new ones for three years.
In 2012, Beloit Memorial Hospital and Northpointe Hospital in Rockton, Ill., used Instymed machines to dispense prescriptions to patients, according to the release. To prescribe medications through the machine, the prescribing doctor sends a prescription to the machine from a computer terminal. The patient can then pick up the medication at the machine by entering some codes and paying for the medications.
In April 2013, a staff member at Northpointe Hospital saw a prescription for Percocet submitted to the machine by Barney, officials said. She realized Barney did not work that day and hospital officials began investigating. A video recording of the area showed Barney taking a prescription from the machine.
Investigators then looked at all of Barney’s Percocet prescriptions at both hospitals, and talked with the patients who had supposedly been prescribed the medication, according to the release. Investigators determined that there were times Barney wrote Percocet prescriptions for patients he had not seen and times he had paid for prescriptions with his own credit card.
Barney got prescription drugs through the Instymed machine approximately 95 times, officials said.Tuesday, April 15 2014, 10:04 PM CDT
