MADISON, Wis. - Same-sex marriages will be put on hold in Wisconsin after a ruling from a federal judge on Friday.
U.S. District Judge Barbara Crabb ordered same-sex marriages to stop while the case is on appeal.
In Crabb's decision, she said that Supreme Court intervention in a Utah case "compels me to stay the decision."
In the order, Crabb also said Gov. Scott Walker should treat same-sex marriage licenses -- which have been issued by all but 12 state counties since last Friday -- the same as different sex couples' licenses.
Crabb said issuing the order "difficult."
"After seeing the expressions of joy on the faces of so many newly wedded couples featured in media reports, I find it difficult to impose a stay on the event that is responsible for eliciting that emotion, even if the stay is only temporary," Crabb wrote. "Same-sex couples have waited many years to receive equal treatment under the law, so it is understandable that they do not want to wait any longer.
"However, a federal district court is required to follow the guidance provided by the Supreme Court. Because I see no way to distinguish this case from Herbert, I conclude that I must stay any injunctive relief pending appeal."
Crabb last week struck down the state's ban as unconstitutional. However, the Crabb created by confusion by not telling state officials how to implement her decision.
Republican Attorney General J.B. Van Hollen was trying to get last week's ruling put on hold to stop clerks from issuing licenses. Van Hollen said Thursday that those clerks could face charges from local district attorneys for breaking the law by issuing the licenses. However, in an email to prosecutors Friday afternoon, Van Hollen clarified that he did not "suggest or recommend criminal charging" county clerks.
