MADISON, Wis. -An 18-year-old charged with shooting his cousin on Badger Road Dec. 26 admitted to police that he knew the gun was loaded when he was playing around with it, according to a criminal complaint.
Elliot Johnson, 18, is being charged with first-degree reckless injury for allegedly shooting his 14-year-old cousin in the chest while playing around with a loaded gun Dec. 26 at an apartment at 914 W. Badger Road.
While passing the gun back and forth, the 18-year-old, who police identify as Johnson, fired a single shot that hit his 14-year-old cousin in the front upper chest area.
According to the criminal complaint, the 14-year-old told police Johnson was playing with the gun and taking pictures of him with it when he accidentally fired the gun.
The 14-year-old told police they got the gun from his mom’s room.
Another teenaged boy who was in the room at the time of the shooting originally told police the 14-year-old had shot himself, according to the release. The teenager eventually changed his story and told police that he saw Johnson load the gun and shoot the 14-year-old.
Johnson originally told police he was in the bathroom at the time of the shooting and denied knowing where the gun came from or who it belonged to, according to the release. But Johnson eventually told police he and his cousin were playing while he held the gun and it went off. Johnson also said he had loaded the gun.
Johnson told police he pulled the trigger six or seven times, even pulling it while the gun was in his mouth, before it went off.
If convicted, Johnson faces a $100,000 fine, 25 years in prison or both. He will back in court Thursday.
