Wisconsin Department of Justice Attorney General Brad Schimel's office said in a news release Friday afternoon that 33-year-old Erik M. Smith was charged Wednesday with four felony counts related to the death of 28-year-old Eric Volp in October 2008.
According to the criminal complaint, Volp was last seen at a bar on the Michigan side of the Wisconsin-Michigan border in Iron Mountain on Oct. 10, 2008. Volp was reported missing that month and his body was recovered eight months later in KC Creek in Marinette County in July 2009. An examination of Volp's body showed fractures to his skull and ribs and the cause of death was ruled as multiple blunt force traumas.
Attorney general spokeswoman Anne Schwartz said Smith was living in Iron Mountain when Volp was killed.
The complaint alleges that Smith and Volp were at a bar on Oct. 10, 2008, and at left at the same time. At some point, the two argued, and when Volp got out of Smith's car, Smith struck Volp and ran him over. Smith reportedly then placed Volp in the trunk of the car and put him in the Marinette County stream.
Police in both Iron Mountain and Marinette County investigated the case, according to the news release. The complaint alleged that Smith has made a statement admitting his involvement in Volp's death and claiming the two had sexual relations the night Volp disappeared.
Schwartz said Smith is in federal custody in a federal prison in Littleton, Colorado, on federal child pornography charges.
Smith was charged with first-degree reckless homicide, homicide by the negligent operation of a motor vehicle, hiding a corpse and hit and run resulting in death. He is scheduled to appear in Marinette County court March 16, Schwartz said.
